Terms and Conditions for Waste Clearance Edgware Services

These Terms and Conditions set out the basis on which Waste Clearance Edgware provides waste clearance and related services to residential and commercial customers in the United Kingdom. By booking or receiving any service from Waste Clearance Edgware, you agree to be bound by these Terms and Conditions.

If you do not agree to these terms, you should not place a booking or use our services.

1. Definitions

In these Terms and Conditions:

Customer means the person, business, or organisation requesting the services from Waste Clearance Edgware.

Services means any waste clearance, rubbish removal, bulky waste collection, or related services provided by Waste Clearance Edgware.

Waste means any items, materials, rubbish, or goods which the Customer instructs Waste Clearance Edgware to remove, transport, or dispose of.

Work Location means the property, premises, or site where the Services are to be provided.

We, us, and our refer to Waste Clearance Edgware. You and your refer to the Customer.

2. Scope of Services

2.1 We provide waste clearance and collection services which typically include the loading, removal, transport, and lawful disposal or recycling of Waste from your Work Location.

2.2 Our services may include, where agreed, the clearance of household waste, office waste, garden waste, light construction waste, bulky items, and general non-hazardous rubbish.

2.3 We do not routinely collect hazardous or specialist waste, including but not limited to asbestos, clinical waste, chemicals, solvents, gas bottles, or pressurised containers, unless this has been expressly agreed in writing in advance and is compliant with applicable waste regulations.

2.4 We reserve the right to refuse to handle any item that we reasonably consider unsafe, prohibited, unlawful to transport or dispose of, or outside the agreed scope of the booking.

3. Booking Process

3.1 You may request a booking for Services by telephone, email, or other contact methods offered by us. At the time of booking, you must provide accurate information regarding:

a. The type and approximate quantity or volume of Waste.

b. The access conditions at the Work Location, including parking availability, floor level, and any restrictions.

c. Any specific items that may be unusually heavy, awkward, or difficult to remove.

3.2 Based on the information provided, we may give an estimate or indicative price range. Any such estimate is not binding until confirmed on site after inspection of the Waste.

3.3 A booking is only confirmed when we have accepted your request and given you a date and estimated arrival time window for the Services.

3.4 You are responsible for ensuring that a responsible adult is present at the Work Location at the agreed time, with authority to agree the final price, sign any documentation, and make payment.

4. Pricing and Quotations

4.1 Prices are usually based on the volume, weight, and type of Waste, the labour required, access to the Work Location, and any disposal or additional fees, such as for mattresses or electrical items where applicable.

4.2 Any quotation given before attending the Work Location is an estimate only, based on the information you provide. The final price will be confirmed on arrival once we have inspected the Waste and access conditions.

4.3 If the quantity or nature of the Waste is significantly different from what was described when booking, we may adjust the price accordingly or decline to carry out the Services.

4.4 All prices will be quoted in pounds sterling and may be subject to applicable taxes.

5. Access and Parking

5.1 You must ensure that we have safe and reasonable access to the Work Location and the Waste to be removed. This includes providing accurate information about stairs, lifts, narrow access, security gates, or other restrictions.

5.2 You are responsible for arranging suitable parking for our vehicle as close as reasonably possible to the Work Location. Any parking costs, fines, or penalties incurred as a result of incorrect information or failure to provide suitable parking may be charged to you.

5.3 If we are unable to gain access to the Work Location at the agreed time due to your fault or omission, we may charge a call-out or wasted journey fee.

6. Payments and Invoicing

6.1 Payment for Services is due in full upon completion of the clearance, unless otherwise agreed in writing in advance.

6.2 We may accept payment by cash, bank transfer, card payment, or any other payment methods we notify you of at the time of booking.

6.3 For business or account customers, payment terms may be agreed separately in writing. If no specific terms are agreed, payment is due within 14 days of the invoice date.

6.4 We reserve the right to withhold Services or to remove part of the Waste only if full payment is not made as agreed.

6.5 If you fail to pay any sum by the due date, we may charge interest on the outstanding amount, and we may take steps to recover the debt, including any reasonable costs incurred in doing so.

7. Cancellations and Rescheduling

7.1 You may cancel or reschedule your booking by contacting us during our normal business hours.

7.2 If you cancel with sufficient notice, we will not normally charge a cancellation fee. We reserve the right to define what is considered sufficient notice, which will typically be at least 24 hours before the scheduled arrival time.

7.3 If you cancel at short notice, or we arrive at the Work Location and are unable to complete the Services due to your act, omission, or failure to provide access, we may charge a reasonable cancellation or wasted journey fee.

7.4 We may need to cancel or reschedule a booking due to circumstances beyond our control, including but not limited to vehicle breakdown, severe weather, staff illness, or unforeseen access issues. In such cases, we will notify you as soon as reasonably possible and arrange a new date. We are not liable for any loss arising from such cancellation or rescheduling.

8. Customer Responsibilities

8.1 You warrant that you are the owner of the Waste or have the full authority of the owner to instruct us to remove and dispose of it.

8.2 You must ensure that no items of value or items you wish to keep are left within the Waste to be removed. Once collected, Waste may be irretrievable.

8.3 You must inform us in advance of any items that may be hazardous, fragile, or pose a risk to health and safety.

8.4 You are responsible for ensuring that the Work Location is safe for our staff, including clear access routes free from undue hazards.

9. Waste Handling and Disposal

9.1 We operate in accordance with UK waste regulations and legal duties relating to the collection, transport, and disposal of controlled waste.

9.2 We will transport all collected Waste only to licensed facilities, transfer stations, recycling centres, or disposal sites that are authorised to receive such Waste.

9.3 We may separate recyclable materials where practical and send them to appropriate recycling or recovery facilities, in line with our environmental practices.

9.4 Title to and responsibility for the Waste transfers to us upon payment and collection, subject to our right to refuse prohibited items. However, if we discover prohibited, hazardous, or illegal items within the Waste after collection, we may notify you and, where lawful, return such items or seek your cooperation in their proper disposal. Any additional costs may be charged to you.

10. Items We Cannot Collect

10.1 Without prior written agreement and compliance with relevant regulations, we do not collect:

a. Asbestos or materials containing asbestos.

b. Clinical or medical waste.

c. Chemicals, solvents, paints, oils, or flammable liquids, other than small household quantities that we agree to take.

d. Gas cylinders, pressurised containers, firearms, or explosives.

e. Any item whose removal or disposal would be unlawful under current UK law.

10.2 If such items are discovered at the Work Location, we may refuse to remove them and may charge for time spent on site and any additional costs incurred.

11. Damage and Liability

11.1 We will take reasonable care when performing the Services. However, you acknowledge that minor scuffs, marks, or wear may occasionally occur during the removal of bulky or awkward items, especially in tight spaces or where access is restricted.

11.2 You must notify us in writing of any alleged damage to the Work Location or property within 48 hours of the completion of the Services. We may request photographs, access for inspection, and any other reasonable information.

11.3 Our total liability for any loss or damage arising from our Services, whether in contract, tort, or otherwise, shall be limited to the amount paid for the specific Service giving rise to the claim, except in cases of death or personal injury caused by our negligence, fraud, or any other liability that cannot be excluded under UK law.

11.4 We are not liable for:

a. Any loss of profits, business, revenue, or anticipated savings.

b. Indirect or consequential losses of any kind.

c. Loss or damage arising from inaccurate or incomplete information provided by you.

d. Loss of items left in, on, or among the Waste that you failed to remove before our arrival.

12. Insurance

12.1 We maintain appropriate insurance cover for our waste clearance operations, including public liability cover in line with industry practice.

12.2 Details of our insurance cover can be made available upon request.

13. Complaints

13.1 If you are dissatisfied with any aspect of our Services, you should contact us as soon as reasonably possible to allow us the opportunity to resolve the matter.

13.2 We will aim to investigate and respond to complaints promptly and fairly. You agree to cooperate with any reasonable requests for information in relation to a complaint.

14. Data Protection and Privacy

14.1 We may collect and process personal data relating to you in order to manage your booking, provide Services, issue invoices, and administer our business.

14.2 We will handle personal data in accordance with applicable data protection laws in the United Kingdom and will take reasonable steps to keep such data secure.

14.3 By using our Services, you consent to the collection and use of your personal data for these purposes.

15. Force Majeure

15.1 We are not liable for any failure or delay in performing our obligations under these Terms and Conditions where such failure or delay results from events, circumstances, or causes beyond our reasonable control. These may include, but are not limited to, extreme weather, natural disasters, acts of government, strikes, lockouts, transport disruptions, or equipment failure.

15.2 If such an event occurs, we will use reasonable efforts to notify you and to perform our obligations as soon as practicable.

16. Variation of Terms

16.1 We may update or amend these Terms and Conditions from time to time. Any changes will take effect when published or otherwise communicated to you and will apply to future bookings.

16.2 The version of the Terms and Conditions in force at the time of your booking will apply to that booking, unless you agree in writing to a new version.

17. Severability

17.1 If any provision of these Terms and Conditions is held to be invalid, unlawful, or unenforceable by a court of competent jurisdiction, that provision shall be treated as deleted, and the remaining provisions shall continue in full force and effect.

18. Entire Agreement

18.1 These Terms and Conditions constitute the entire agreement between you and Waste Clearance Edgware in relation to the Services, and supersede any prior understandings, statements, or agreements, whether written or oral.

18.2 No variation of these Terms and Conditions shall be binding unless made in writing and agreed by an authorised representative of Waste Clearance Edgware.

19. Governing Law and Jurisdiction

19.1 These Terms and Conditions and any dispute or claim arising out of or in connection with them, or with the provision of the Services, shall be governed by and construed in accordance with the laws of England and Wales.

19.2 You and we agree that the courts of England and Wales shall have exclusive jurisdiction to settle any dispute or claim arising out of or in connection with these Terms and Conditions or the Services.
